Overview
These terms and conditions apply to all floral design, event styling and hire services provided by Poppylush Floral Studio ("Poppylush", "we", "us" or "our"). By paying a deposit or confirming a booking, you ("the client") agree to these terms, together with the details in your quote and booking confirmation.
Nothing in these terms excludes, restricts or modifies any rights you have under the Australian Consumer Law.
Quotes and bookings
- Quotes are valid for 14 days unless otherwise stated, and are based on the information you provide, such as your date, venue, guest numbers and design.
- Your date is only secured once you have accepted your quote and paid the booking deposit. Until then, we may accept other bookings for the same date.
- Final details, including quantities, designs and timings, should be confirmed no later than the date set out in your booking confirmation.
Payments
- A non-refundable booking deposit is required to secure your date. The amount is shown on your quote.
- The remaining balance is due by the date stated on your invoice, before your event.
- If the balance is not paid by the due date, we may treat the booking as cancelled and the cancellation terms below will apply.
- Prices are in Australian dollars and include GST where applicable.
Changes to your booking
We are happy to help with changes wherever we can. Changes to your design, quantities or event details are subject to availability and may change your price. Reductions made close to your event may not be possible, as flowers and materials are ordered in advance. If you need to change your event date, let us know as soon as possible; we will do our best to move your booking, subject to our availability.
Cancellations
- If you cancel your booking, your deposit is non-refundable, as it covers the date we have held for you and the design work already completed.
- Cancellations made after flowers, materials or hire items have been ordered or prepared may incur further charges, as set out in your booking confirmation.
- If we ever need to cancel because of circumstances beyond our control, we will offer a full refund of the amounts you have paid for the undelivered services, or help arrange a suitable alternative.
Flowers and substitutions
Fresh flowers are natural products and vary in colour, size and shape. Seasonal availability, weather and supply can affect certain blooms. Where a flower is unavailable or not of the quality we expect, we will substitute it with one of similar style, colour and value, keeping the overall look and feel of your design. Faux florals are selected to match your design as closely as possible.
Hire items
- Hire items remain the property of Poppylush at all times and are hired for the event date and period shown in your booking.
- A security bond may be required for some items. It is refunded after the items are returned and checked, less any costs for damage, missing items or extra cleaning.
- You are responsible for the hire items from delivery until collection. Please make sure they are used as intended and are not moved, altered or taken off-site without our agreement.
- Lost, damaged or stolen items will be charged at their repair or replacement cost.
- Items must be ready for collection at the agreed time and place. Delays in collection caused by the venue or client may incur additional fees.
Delivery, set-up and pack-down
Delivery, set-up and pack-down times are agreed in your booking confirmation. You are responsible for arranging access to the venue at these times and for letting us know about any venue rules or restrictions. Extra time, waiting, after-hours or difficult access (such as stairs or long carries) may incur additional charges.
Venue and safety
Some designs, such as candles, hanging installations and structures, may be subject to venue approval. It is your responsibility to confirm that our designs are permitted at your venue. We may adjust or decline a design element if we believe it is unsafe.
Photography and our work
Our designs, concepts, mood boards and proposals remain our intellectual property. We may photograph our work at your event and use the images in our portfolio, website and social media. If you would prefer we do not share images from your event, please let us know in writing.
Liability
To the extent permitted by law, our liability for any loss arising from our services is limited to the amount you have paid for those services. We are not responsible for delays or failures caused by events beyond our reasonable control, including extreme weather, supplier shortages, road closures or venue restrictions. This does not affect your rights under the Australian Consumer Law.
Privacy
We handle your personal information in line with our Privacy Policy.
Governing law
These terms are governed by the laws of Victoria, Australia, and you agree to the non-exclusive jurisdiction of the courts of Victoria.
